-vehicle accident early this morning which killed the lone passenger cowboys teammate jerry brown, a member of the practice squad. irving, texas police spokesman had this to say early today. >> mr. price brent was asked to perform some field sobriety tests. after he performed those field sobriety tests based on his performance of those tests along with our officers' observations and the conversations that they had with him, he was placed under arrest for driving while intoxicated. once our officers learned that mr. brown had passed away then mr. price brent was under arrest for intoxication manslaughter. >> tim: brent and brown were teammates at the university of illinois. brent was suspended from the illini team in 2009 after a d.u.i. arrest. he was sentenced to 60 days in jail. 200 hours of community service and two years probation for that offense. his current charge is a second-degree felony punishable by two to 20 years of imprisonment and a fine of up to $10,000. to be with you. i'm terrell brown. a strong earthquake hit northeastern japan this morning, the magnitude 7.3 quake struck in the early evening in the same area that suffered a powerful quake and tsunami last year. a tsunami warning has been issued. residents have been told to move to higher ground. the fukushima nuclear plant has not been damaged. the quake was felt as far south as tokyo. lucy craft is in tokyo. what can you tell us? >> reporter: no reports of damage or injury. it's still way too early. we have a tsunami warning. the tide is about three feet or two meters or one meter, i should say. very interesting, this time the warnings came very fast and furious. the announcer was yelling at people to get to higher ground. big difference this year. >> we were watching in our newsroom as the alerts came in. what did you feel, what did you experience there? was it anything noticeable? >> i was talking to someone on the phone and she said she should get off the phone, this is a big one. my windows were rattling. my pictures, i thought i was going to have to grab them before they fell off.

be the brown v. board of education for gay and lesbian couples. or the case before it that embraced segregation. it's very hard to predict. it leaves many of us very, very nervous. it's not just the 120,000 couples in this country who are gay or lesbian and married but it affects all of us. we currently have a country that disenfranchises people who want to marry for love and we don't let them. 31 states prohibit those type of marriages. >> a lot of people come back to the 1960s in loving versus west virginia and whether it will mirror that merely 50 years later. the court, though, has ten marriage equality cases to choose from. as i pointed out, they only chose two. if i know this correctly, they had eight different ones to consider choosing and two prop 8 ones. they have one doma and one prop 8. >> what's fascinating, this is a court that has avoided this issue. it's been pathological. everyone in lawrence v. texas, the opinion was distorted in my ways because of a clear effort not to say anything that would have baring on the same-sex marriage issue. suddenly, they take two issues with the b
